Conditional Cash Transfers (recurrent). Schedule 2. Section I.D.Throughout Project Implementation, the Borrower, through MIDES,shall provide Conditional Cash Transfers under Part 2 of the Project in accordance with the updated CCT Operations Manualacceptable to the Bank.
Procurement (recurrent). Schedule 2, Section IIIAll goods, works, non-consulting services and consulting services required forthe Project and to be financed out of the proceeds of the Loan shall be procured in accordance with the requirements set forth orreferred to in the Procurement Regulations and the provisions of the Procurement Plan.
Throughout Project implementation, the Borrower shall ensure that MSPAS functions in a manner and with adequate staffing andbudgetary resources, all acceptable to the Bank, and as set forth in the Operations Manual.
No later than three (3) months after the Effective Date, the Borrower, through MSPAS, shall hire and maintain throughout theimplementation of the Project, as a minimum, professionals in the following areas: FM, accounting, budget , procurement,environment, and social, as set forth in the Operations Manual with qualifications and experience, and under ToRs acceptable to theBank.
For purposes of providing general Project oversight and coordination, the Borrower through MSPAS shall, not later than three monthsafter the Effective Date, establish, and thereafter operate and maintain, throughout the implementation of the Project, a committee(the Steering Commitee), ..., including representatives of SESAN and MIDES, all acceptable to the Bank, as set forth in the OManual.
For purposes of facilitating the implementation of the Project, and no later than three (3) months after the Effective Date, theBorrower, through MSPAS, shall enter into separate arrangements with : (a) MIDES; and (b) SESAN, (“Inter InstitutionalArrangements”), all under terms and conditions acceptable to the Bank.
To facilitate the carrying out of Part 1(c)(i) of the Project, and prior to the implementation of any Water Subproject under saidPart of the Project that falls within the administrative jurisdiction of any given Participating Municipality, the Borrower,through MSPAS, shall enter into an agreement with said Participating Municipality (the “Water Subproject Agreement”) acceptable tothe Bank.
The Borrower, through MSPAS, shall exercise its rights and carry out its obligations under each Water Subproject Agreement in suchmanner as to protect the interests of the Borrower and the Bank and to accomplish the purposes of the Loan. Except as the Bankshallotherwise agree, the Borrower, through MSPAS, shall not assign, amend, abrogate, waive, terminate or fail to enforce any WaterSubproject

The Borrower, through MSPAS, shall ensure that the Project is carried out in accordance with the provisions of the Anti-CorruptionGuidelines.
The Borrower, through MSPAS, shall carry out the Project in accordance with the ESMF. Except as the Bank shall otherwise agree,the Borrower, through MSPAS, shall not assign, amend, abrogate, terminate, fail to enforce or waive the ESMF or any of itsprovisions thereof. The Borrower, through MSPAS, shall ensure that the terms of reference of any consultancy in respect to Part 1of Project.

Tax information is exchanged with other countries as twelve tax information sharing agreements have been signed
In addition to the seven agreements already signed, a draft TIEA has been agreed upon with Australia, but its signature is pendingprocedural steps to be taken by the Australian Government. In 2012 Guatemala signed the Agreement on Mutual Assistance andTechnicalCooperation between the Tax and Customs Administrations in Central America (equivalent to an additional 4 TIEAs). Inaddition, in December 2012 the Guatemalan government signed the OECD Multilateral Convention on Mutual Administrative Assistance inTax Matters. This now allows Guatemala to exchange tax information with 45 countries including including with the USA and Mexico.The OECD has moved Guatemala from the "gray list" to the list of countries that have made substantial progress in terms oftransparency in tax matters. Cumulative value for 2011
Annual cumulative tax collections in 2012 were 10.85 percent of 2012 GDP. Only a small part of the 2012 tax reforms was effectivein 2012; an income tax reform became effective in January 2013. A fall in import values led to a weak performance in import tariffsand import-related VAT collections. Cumulative tax collections between January-April 2013 were 3.83 percent of the projected GDPfor 2013. (Source: SAT). Annual cumulative tax collection for 2013 is estimated at around 11.4 percent of GDP.

The Borrower shall include specific activities in the Operational Manual ensuring that indigenous peoples will have access tohealth and education services in a culturally appropriate manner.
The Borrower shall adapt the EMF, in a manner satisfactory to the Bank, including, inter alia: (i) the mechanisms to strengthencompliance with national standards for health care waste management; (ii) the development of action plans to ensure compliance withtheBorrower's regulations; and (iii) measures to address the gaps in implementation or quality of implementation of the EMF.
